Terms of Service

By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Gonow Driving School - ABN 42 569 669 298.

These terms and conditions (“the Terms”) govern the agreement between the Customer (“you”), the Instructor and Gonow Driving School ABN 42569669298 of PO Box 6177 Kincumber NSW 2251, you are bound by the Terms.

Lessons

Booking Lessons with us

COVID 19    - In event of Lock Downs

ALL PRE-PAID LESSONS WILL BE REBOOKED WHEN POSSIBLE TO ENSURE THE SAFETY OF CLIENTS AND STAFF

THANK YOU FOR YOUR UNDERSTANDING PLEASE TAKE CARE  - STAY SAFE  - FROM GONOW DRIVING

WHS for Covid-19 Masks and gloves will be provided if you require them. When NSW Health make masks mandatory than they must be worn.

New rules - require all clients to notify if they have any symptoms of cold or feeling unwell - Due to Covid -19 if in the last 14 days they have been in close contact with anyone who has COVID-19; is suspected to have COVID-19; are showing any symptoms of COVID-19 themselves; or have recently visited any COVID-19 hot spot locations.

All clients are to have temperature checks and have a mask before entering the vehicle - hand sanitiser needs to be used before lesson commence - due to department of health. 

Due to WHS for all clients - Gonow Driving require that NO PERFUME OR AFTERSHAVE be worn for lessons -

If the Learner Driver is under 18 Years

A service agreement will be required to be completed and signed by the driver under the age of 18 years of age and counter-signed as confirmation by a Parent or Guardian. 

If the Learner Driver is over 18 Years

• A service agreement will be required to be completed and signed by the driver only.
• Lessons and lesson packages areas described on web page https://www.gonowdrivingschool.com.au
• When making a booking person over 18 years of age required to provide your email address on booking of first lesson so a Service Agreement can be emailed prior to first lesson commencing.
• Payment of lesson required before commencement of lessons/lessons.
• BSB payments cleared 48 hours prior to commencement.
• Otherwise cash will be required at commencement of lesson before lesson can commence. 
• If change lesson appointment time prior to booking and providing is over 48 hours notice funds paid will transferred to future lesson / lessons.
• The Lesson pick up and drop off point are as booked or agreed by Instructor prior to lesson commencement. 

Cancelling the Lesson

To cancel a Lesson with us, you must do so through Gonow Driving School by contacting us directly via email  info@gonowdrivingschool.com.au

1.    If you cancel your Lesson more than 48 hours prior to your booked date and time, then we use your credit towards another Lesson at a later date.

2.    If you cancel your Lesson less than 48 hours prior to your booked date and time, then you will be charged the full amount and no credit will be given.

3. If a lesson is cancelled more than twice - than a refund is requested - 50% of total money will be the money refunded.

Rescheduling Of Lessons

To reschedule a Lesson with us, you must do so through Gonow Driving School by contacting us directly  via email info@gonowdrivingschool.com.au

1.    If you reschedule either with less than 48 hours advance notice of the scheduled time, we reserve the right to consider the Lesson cancelled and charge the full amount. 

We may reschedule a Lesson at any time by giving you reasonable notice including by telephone, email or SMS.

Lateness and Non-Attendance (No Shows)

If you arrive late for a Lesson the Instructor may only be able to offer you the remaining Lesson time and you will be charged for the full Lesson.

If you are more than 15 minutes late for a Lesson, we reserve the right (at the Instructor’s reasonable discretion) to cancel the Lesson and charge the full Lesson Cost.

When We Will Terminate A Lesson (at the Instructor’s reasonable discretion)

Reason for terminating Lesson 

1.    You do not comply with ethics at the commencement of or at any time during the lesson. Behave in a unlawful manner, inappropriate conversation topic e.g.: Topic of sexual nature. Abusive behaviour towards Instructor. Act in untrustworthy manner. Learner or guardian attempts to bribe the Instructor, any such actions are reported in accordance with RMS Policy and Procedure.

2.    The Service Agreement is not completed, signed or provided at the commencement of the Lesson.

3.    It is not safe to conduct the Lesson at the scheduled commencement of the Lesson due to your specific issues or consumption of substances that the Instructor decides may affect your ability to drive and make it unsafe for you, for the Instructor and/or other road users for the Lesson to take place.

4. Lesson will terminate if speeding over the posted speed limit, In your own vehicle or instructors, also if unsafe driving at any time.

RECORDING ANY CONVERSATION OR DRIVING LESSONS

Gonow Driving School DO NOT PERMIT the use of any listening or recording device in any driving lessons. What device ?- any device including mobil phones that are capable to be used to monitor, record, overhear or listen to a private conversation at the time it takes place.

If any Gonow Driving Instructor feels that this is taking place - They have the right to terminate any such recording resulting in the remainder of the lesson or any other future lessons to be forfeited with no refund given.

Acknowledgements

By booking lessons with us, you acknowledge that:

• The Instructor has sole discretion as to whether a Lesson will commence or continue.
• Participation in a Lesson does not guarantee that you will acquire the necessary skills to pass any driving test.
• Driving a motor vehicle is an inherently risky activity and there is the risk of significant personal injury or damage to property.
• Gonow Driving School may record telephone calls received or made by us for training and quality assurance purposes.
• We do not accept any liability whatsoever for personal property that is left in a Vehicle or on our premises.
• If you are not the Learner, you have made the Learner aware of these acknowledgements.
• The duration of Lesson (including both on-road and off-road time) includes briefing and de-briefing time.

Service Agreement

Our Service Agreement will be emailed to you prior to the commencement of first lesson to the email address provided by you at the time of booking. 

You also need to advise if your licence has been suspended, disqualified or restricted in the past 3 years.

You will need to read, complete, and sign this Agreement and provide it to us for lessons you have with us.

By you providing all information you cover all reasonable precautions necessary for your safety, the safety of Gonow Driving Instructors and other road users.

Service Agreement is the duty of disclosure by you advising us of specific issues that may affect your ability to drive and specific substances consumed by the Learner Driver in 12 hours prior to commencing any lessons.

You, either as the Learner Driver and/or the Guardian thereof, need to advise us if the Learner Driver has consumed of any of the following in 12 hours prior to commencing any lesson:

1.    medications;

2.    alcohol;

3.    illicit drugs;

4.    any other substance that may impair your ability to drive a vehicle. 

Note:

Some over the counter medications have specific labels that you must not drive a vehicle or operate heavy machinery.

If you are on prescribed medications, then a medical clearance by a Doctor will need to be provided for each medication that may affect the Learner Driver’s ability to drive.

Important – Illicit Drugs:If the Learner Driver has consumed an illicit drug 48 hours prior to the booked Lesson and it has not been cancelled as stipulated above, then the Learner Driver will be refused the Lesson and no refund will be given. 

You agree by signing the Service Agreement that when using the Instructor vehicle, the Learner Driver take care of the vehicle and follow instructions of the Instructor at all times. 

In the safety of yourself and the Instructor, if at any time deemed by the Instructor that the Learner Driver’s actions are unsafe, then at the discretion of the Instructor, the Instructor has the right to terminate the lesson and a full cost of the service Lesson will be charged.

Use of your Photo in Social Media

To acknowledge your driver training success and or/ passing your driving test, Gonow Driving School would like to publish your picture on our social media sites (which may include Facebook, Web, Google Plus, Instagram, Twitter). 

If you do NOT wish to have your picture published in this manner please advise your instructor at the time you have either successfully completed your driver training and or / passing your driving test. 

Meaning Of Words

In this agreement:

• Client means the person entering into this agreement. Lesson Cost, packages, or other valid charges.
• Content means all text, graphics, video, data or other content on the Lesson Management System Site or the websites.
• Deposit means the process of making a deposit of funds into bank using one of the Payment Methods, which will be available for payment of lesson booking charges after Payment Clearance.
• Driving Test means a pre-booked driving test with the Roads and Maritime Services NSW.
• Driving Test booking fee means fee paid to us to book your driving test with Roads and Maritime Services NSW
• Instructor means a licensed driving instructor you book to provide a Learner with a Lesson.
• Learner means the person undertaking a Lesson through Gonow Driving School as notified by you at the time of the booking.
• Lesson means a car for the purpose of Class C, driving lesson provided by the Instructor.
• Lesson Cost means the Price net of any applicable discounts.
• Payment Methods means Electronic Funds Transfer (EFT), Credit Card payment (either VISA or Mastercard), Direct Deposit to our nominated bank account as advised online,  payment to the Instructor as arranged at the time of making the booking.
• Payment Clearance means the time between you making a payment using a Payment Method other than Credit Card and the Deposit appearing in the banking records of Gonow Driving School.
• Price means the price charged to the Customer for the Lesson set out in this document as varied from time to time and advised to you prior to payment, but always before any discounts where applicable Cancellations and No Shows and other fees and charges payable to the Gonow Driving School and the Instructor.

Website content and access

• We endeavour to take reasonable care in preparing and maintaining the information available on this website, but we do not warrant the accuracy, reliability, adequacy or completeness of any of the information on this website.
• You acknowledge that the website may contain content which is inaccurate, incomplete or contains errors (including typographical errors).
• The website and content are subject to change at any time without notice and the information on the website may not be current at the time you view it.
• It is your responsibility to make enquiries as necessary to ensure the accuracy and currency of the information contained on this website.
• We disclaim all liability for loss directly or indirectly arising from your reliance on the website and its content.
• The Site contains links to other websites as well as content added by people other than us. We do not endorse, sponsor or approve any such user generated content or any content available on any linked website.

Intellectual Property Rights

• Nothing in these Terms constitutes a transfer of any intellectual property rights. You acknowledge and agree that we own all intellectual property rights in the Site.

Liability

• To the full extent permitted by law, we exclude all liability in respect of loss of data, interruption of business or any consequential or incidental damages.
• To the full extent permitted by law, we exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these Terms.
• These Terms are to be read subject to any legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, conditions, guarantees or obligations. If such legislation applies, to the extent possible, we limit our liability in respect of any claim to, at our option, in the case of services:
• the supply of the services again; or
• the payment of the cost of having the services supplied again.
• You acknowledge that we have a "Ratings and Reviews" function of our Site. You acknowledge that users of our website may publish comments on our Site. You acknowledge that the views and opinions expressed in such comments are made by third-parties and are not representations made by us. We do not endorse any such comments and we make no representations about the accuracy or suitability of such comments. You are recommended to make your own enquiries and seek your own advice before relying on such comments
• We are not liable for any financial or non-financial loss or damage to you or your business caused directly or indirectly by any ratings or reviews made on our Site.

• This Site contains advertisements and information provided by third parties. General

• If a provision of these Terms is invalid or unenforceable it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.
• This Agreement is governed by the laws of New South Wales and each party submits to the jurisdiction of the courts of New South Wales.

Privacy Policy

• If you use our Site you acknowledge that you have read, understood and you agree to the terms of our privacy policy.

Account Terms

This page contains the most current version of the Terms of Service.

• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  
• You are responsible for all activity that occurs from your account.
  
• You agree that Gonow Driving School can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  
• You must not post or submit false information to the Service.
  
• You are responsible for maintaining the security of your account and password. Gonow Driving School cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  
• Gonow Driving School has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Gonow Driving School service, for any reason.
  
• Violation of any of the terms or general conditions may result in the termination of your Account.
  
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Gonow Driving School has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Gonow Driving School service. Such termination of the Service will result in the deactivation of your Account.
  

Cancellation Rates

• Less than 48 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Gonow Driving School.

 

Modifications to Services and Prices

• Gonow Driving School reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  
• Prices of all Services are subject to change with or without notice.
  
• Gonow Driving School shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
  

Vouchers

• Vouchers are non-refundable and cannot be redeemed for cash.
• Unused vouchers cannot be transferred between clients.
• Purchases containing multiple vouchers can only be used by a single person and cannot be split between people.
• Vouchers are valid for 24 months from the date of purchase.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Gonow Driving School for payment processing.
  
• All fees and transactions are in Australian Dollars.
  

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Gonow Driving School.
  
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Gonow Driving School customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
  
• You must not transmit any worms or viruses or any code of a destructive nature.
  
• You understand that Gonow Driving School uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  
• Gonow Driving School does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  
• You expressly understand and agree that Gonow Driving School shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Gonow Driving School has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  
• The failure of Gonow Driving School to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  
• You expressly understand and agree that Gonow Driving School shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
